Zoning Board of Appeals 02/09/06

Chair Pontbriand called the meeting to order at 7:00 pm.

7:00 pm   06-05  Karl and Audrey Trieschman, 14 Wigwam Street, Map 35, Parcel 134:   Application for a Special Permit under WZB 6.1.5.1:  Construct a deck within the side setback.  The Board for the Hearing consisted of Trevor Pontbriand, William Nicholson, Sibel Asantugrul, Charles Amsler and Vern Jacob. A site visit was made.  Bob Creonte represented the applicant.  The proposed 16 ‘ by 16’ deck will be located within the side setbacks.  William Nicholson moved for Findings of Fact:
1.      The subject property is pre-existing, non-conforming due to lot size and setbacks.
2.      There is no increase in use.
3.      There will be no further lot coverage.
4.      The decking is in keeping within other properties in the neighborhood.
5.      There are no objections from abutters.
Trevor Pontbriand moved to grant a Special Permit based on the Findings of Fact; seconded by William Nicholson; passed 5-0.

06-06   Brian Pilcher and Rebecca Foust, 475 Chequessett Neck Road, Map 19, Parcel 125:  Application for a Special Permit under WZB 6.1.5.1:  Construct dormer on the SW corner of existing dwelling.  The Board consisted of Trevor Pontbriand, William Nicholson, Sibel Asantugrul, Charles Amsler and Vern Jacob.   A site visit was made.  Chet Lay of Slade Associates represented the applicants as well as John Webster of Webtech.  Chet Lay stated the proposed dormer would not be going into the setbacks any further.  Trevor Pontbriand asked if the dormer was for an expanded bedroom, and Webster replied that it was only going to be used as attic space.  He stated it would balance the façade with the existing dormer on the other side of the dwelling.  William Nicholson moved for Findings of Fact:
1.      This is a pre-existing, non-conforming structure due to side setbacks.
2.      There will be no increase in lot coverage.
3.      There will be no increase in use.
4.      There were no objections from abutters.

5.      There will be no further intrusion into the setbacks.
6.      There will be minimal volumetric increase.
William Nicholson moved to grant a Special Permit based on the Findings of Fact; seconded by Trevor Pontbriand; passed 5-0.

Trevor Pontbriand moved to adjourn the meeting at 7:15 pm.
